As part of the Assurance, Deutsche Asset Management agreed to pay $122,314,360, of which $20 million represents a civil penalty and $102,314,360 represents disgorgement, into a Qualified Settlement Fund for the benefit of injured shareholders.
The Assurance specified the appointment of Navigant Consulting, Inc. ("Navigant") as the Distribution Consultant ("DC"). Michael H. Chase, who is leading this project for Navigant, has 23 years of expertise providing accounting investigation services and financial analyses. His work has included forensic accounting investigations, related expert analysis, expert reports and testimony. The DC has overall responsibility for the preparation, execution, and completion of a Distribution Plan to distribute the $122,314,360, plus interest, to eligible shareholders. The DC did not receive any objections to the August 20, 2007, proposed distribution plan. The recipients of the settlement monies will be shareholders who held shares in certain funds within the Scudder Family of Funds (see attached Fund List) between January 1998 and September 2003 and who were determined by the DC to have been adversely affected by market timing activity described in the Assurance. The methodology utilized to determine whether a shareholder is eligible for the distribution is based upon specific criteria established by the DC and accepted by Deutsche Asset Management, the Independent Trustees, and the NYAG.
Some shareholders may also qualify to receive a distribution from the Bear Stearns Fair Fund Settlement. If a shareholder is eligible, their portion of the Bear Stearns Fair Fund Settlement is included in their distribution check and broken out on the check stub.
